SMS Consent & Text Messaging Policy

(Zoom Phone Compliance Policy)

1. Purpose

This policy establishes the requirements for obtaining, documenting, and honoring customer consent for sending SMS (text) and MMS messages using Zoom Phone. The goal is to ensure compliance with Zoom policies, mobile carrier requirements, and applicable federal and state laws.

2. Scope

This policy applies to:

  • All employees, contractors, and authorized users

  • All Zoom Phone numbers owned or managed by the company

  • All SMS and MMS messages sent for business, operational, or marketing purposes

3. Consent Requirements

3.1 Prior Express Consent

The company must obtain prior express consent from a recipient before sending any SMS or MMS message, except where the recipient initiates the conversation.

Consent must be:

  • Clear and informed

  • Specific to the sender

  • Specific to the type of messages (e.g., appointment reminders, service notifications, billing updates, or marketing)

Providing a phone number alone does not constitute consent.

3.2 Acceptable Methods of Obtaining Consent

Consent may be collected through:

  • Web or digital forms with clear SMS opt-in language

  • Written or paper consent forms

  • Verbal consent (where legally permitted and documented)

  • SMS keyword opt-in (e.g., user texts “START” or “YES”)

  • Customer-initiated SMS conversations

3.3 Required Consent Disclosure

At the time consent is obtained, recipients must be informed of:

  • The company name (message sender)

  • The type of messages they will receive

  • That message and data rates may apply

  • How to opt out at any time

4. Consent Recordkeeping

The company will retain proof of consent for a minimum of four (4) years.

Consent records must include:

  • Phone number

  • Date and time consent was obtained

  • Method of consent

  • Message category approved (transactional, informational, or marketing)

These records must be produced upon request by Zoom or mobile carriers.

5. Opt-Out & Revocation of Consent

Recipients may revoke consent at any time by replying with any of the following keywords:

  • STOP

  • CANCEL

  • END

  • QUIT

  • UNSUBSCRIBE

Opt-out requests must be honored immediately. No further messages may be sent unless new consent is obtained.

6. Message Content Rules

All SMS messages must:

  • Clearly identify the company as the sender

  • Match the message type the recipient consented to receive

  • Be truthful, lawful, and non-deceptive

The following are strictly prohibited:

  • Spam or unsolicited messages

  • Purchased, rented, or third-party contact lists

  • Misleading, abusive, or illegal content

  • Circumventing opt-out mechanisms

7. Campaign Registration (10DLC)

All Zoom Phone numbers used for SMS must be properly registered with The Campaign Registry (10DLC) when required. Messaging may be blocked or suspended if registration or consent requirements are not met.

8. Compliance With Laws & Zoom Policies

This policy is designed to comply with:

  • Zoom Phone Text Messaging Policy

  • Mobile carrier requirements (CTIA & 10DLC)

  • Telephone Consumer Protection Act (TCPA)

  • Applicable state and federal regulations

Compliance with this policy is mandatory. Violations may result in disciplinary action and suspension of SMS privileges.

Failure to follow this policy may result in:

  • Loss of Zoom Phone SMS functionality

  • Carrier message blocking

  • Financial penalties

  • Internal disciplinary action
